Please read these Terms of Service ("Terms") carefully before using the Golden Concierge website at yourgoldenconcierge.com, our mobile application, or engaging our services. These Terms constitute a legally binding agreement between you and Golden Concierge, LLC ("Golden Concierge," "we," "us," or "our").

By accessing our website, downloading our app, or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website, app, or services.


1. About Golden Concierge

Golden Concierge, LLC is an Iowa-based senior care concierge company providing care coordination, Medicaid planning and case management, senior placement assistance, move management, and related concierge services to seniors and their families across Iowa. We are a licensed and insured Iowa business.

Our role is advisory and coordinative. We do not provide legal advice, medical advice, financial advice, or tax advice unless expressly stated in a separate written agreement with an appropriately licensed provider. Nothing on our website or in our app constitutes professional legal, medical, financial, or tax advice.


2. Eligibility

Our website and app are intended for use by adults 18 years of age and older. By using our services, you represent that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are acting on behalf of a senior client as their authorized representative (Power of Attorney, guardian, or conservator), you represent that you have legal authority to do so.


3. Services

The specific services provided to each client are governed by the applicable signed service agreement, including the Client Commitment Contract and, where applicable, the Medicaid Planning, Case Management & Coordination Agreement. In the event of any conflict between these Terms and a signed service agreement, the signed service agreement controls.

Services offered by Golden Concierge may include:

  • Senior care coordination and placement assistance
  • Medicaid pre-planning and application coordination
  • Case management and documentation coordination
  • Move management and home transition support
  • Benefits navigation and advocacy
  • Educational resources, newsletters, and community events

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.


4. Client Accounts and the Client Dashboard

Certain features of our mobile app are available only to registered clients through our secure Client Dashboard. To access the Client Dashboard, you must create an account using a valid email address and password.

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized access to your account

Client Dashboard access is granted only to individuals who have completed and signed our Client Commitment Contract, HIPAA Authorization and Consent Form, and Financial Authorization and Consent Form. By accessing the Client Dashboard, you confirm that these agreements are in place and govern your use of the portal.

We reserve the right to suspend or terminate any account that violates these Terms or our service agreements.


5. Accurate Information

You agree to provide accurate, complete, and current information when using our services, completing our forms, or communicating with our team. You acknowledge that Golden Concierge relies entirely on the information you provide and does not independently verify financial or medical data. Providing false or misleading information may result in delays, denials, or termination of services, and may have serious consequences for Medicaid eligibility or other outcomes.


6. Communications and Marketing

By providing your name, email address, and phone number to Golden Concierge — whether through our website, app, in person, or by phone — you consent to receive communications from us, which may include:

  • Our monthly dementia and caregiving newsletter
  • The Golden Concierge magazine and educational publications
  • Marketing emails about our services, events, and community resources
  • Phone calls and text messages related to your inquiry or our services

You may opt out of marketing communications at any time by clicking the unsubscribe link in any email, replying STOP to any text message, or contacting us at (515) 303-2872. Standard message and data rates may apply to text messages.


7. No Guarantee of Outcomes

Golden Concierge cannot and does not guarantee:

  • Medicaid approval, specific eligibility determinations, or application outcomes — final decisions rest solely with the Iowa Department of Health and Human Services (DHS) or applicable governing agencies
  • Admission to any senior living community, skilled nursing facility, assisted living, or care setting
  • Availability, quality, timeliness, safety, or performance of any third-party provider, facility, vendor, or service
  • The outcome of any legal, financial, medical, or care-related matter

Our fees are for professional time, coordination, expertise, and preparation of materials — not for the guarantee of any specific outcome.


8. Third-Party Services and Providers

Golden Concierge may refer, introduce, coordinate, or schedule third-party providers including moving companies, contractors, home health agencies, senior living communities, legal professionals, financial advisors, and others. When we do so, we act solely as a coordinator and assume no responsibility for the performance, quality, safety, billing, or outcome of those third-party services.

You are solely responsible for evaluating and selecting any third-party provider, regardless of whether that provider was introduced by Golden Concierge. We encourage you to perform your own due diligence before engaging any third party.

Our website and app contain links to third-party websites including resource organizations, government agencies, and community groups. We do not endorse and are not responsible for the content, accuracy, or practices of those sites.


9. Payment Terms

Payment terms for services are governed by your signed service agreement. General terms include:

  • Golden Concierge accepts payment by check, credit card, or electronic transfer (ACH, wire, or online invoice)
  • Payments not received within thirty (30) days of the due date may incur a late fee of 5% of the outstanding balance or the maximum amount permitted by Iowa law
  • All payments are non-refundable once services have commenced, as fees are based on professional time and services rendered
  • Invoices for Medicaid planning services may be submitted to DHS as spend-down documentation; eligibility for spend-down consideration is determined solely by DHS
  • Where a contracted senior living community has agreed to pay Golden Concierge's placement fee in writing, we will invoice the community directly and will not seek that fee from the client

10. Intellectual Property

All content on our website and app — including text, graphics, logos, images, videos, podcasts, educational materials, and newsletters — is the property of Golden Concierge, LLC or its content partners and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.

You may share links to our public content and use our materials for personal, non-commercial educational purposes.


11. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at www.yourgoldenconcierge.com/privacy to understand our data practices.


12. Disclaimer of Warranties

Our website, app, and services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our website or app will be uninterrupted, error-free, or free of viruses or other harmful components.

The educational resources, articles, videos, podcasts, and other content available through our app and website are for informational purposes only and do not constitute professional medical, legal, financial, or Medicaid advice.


13. Limitation of Liability

To the fullest extent permitted by Iowa law, Golden Concierge, LLC and its owners, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, website, or app.

Golden Concierge's total liability for any claim arising under these Terms or any service agreement shall not exceed the total amount of fees actually paid by you to Golden Concierge during the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms is intended to limit liability for gross negligence, willful misconduct, or fraud to the extent such limitation is prohibited by applicable law.


14. Indemnification

You agree to indemnify, defend, and hold harmless Golden Concierge, LLC and its owners, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising out of or related to: (a) your use of our services, website, or app; (b) your violation of these Terms; (c) inaccurate or incomplete information you provide; or (d) your decisions regarding care, housing, finances, or third-party services.


15. Dispute Resolution

Before filing any lawsuit (except for small claims matters or requests for temporary injunctive relief), you agree to first contact Golden Concierge and attempt to resolve any dispute informally. If informal resolution fails, disputes shall be resolved through mediation in Polk County, Iowa with a mutually agreed mediator. If mediation is unsuccessful within thirty (30) days, disputes shall be resolved by binding arbitration in Polk County, Iowa under the rules of the American Arbitration Association (AAA).

By agreeing to these Terms, you waive your right to a jury trial or court proceeding, except to enforce or confirm an arbitration award. Either party may bring individual claims in small claims court if the claim qualifies.

These Terms are governed by and construed in accordance with the laws of the State of Iowa.


16. Separate and Affiliated Businesses

Golden Concierge may reference or discuss services available through affiliated but legally separate businesses, including Chase Collective (a licensed Iowa real estate brokerage) and Golden Concierge Fiduciary, LLC. You are under no obligation to use any affiliated business. Any engagement with an affiliated business requires a separate written agreement governing its terms, scope, fees, and responsibilities. These Terms do not create any obligation to use any affiliated company.

Real estate services (listing, purchase, sale, or brokerage representation) are not provided under these Terms and are governed solely by a separate written agreement with Chase Collective.


17. Modifications to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Revised" date at the top of this document and, where appropriate, notify active clients by email or through the app. Your continued use of our website, app, or services after any changes constitutes your acceptance of the updated Terms.


18. Termination

We reserve the right to suspend or terminate your access to our website, app, or services at any time for violation of these Terms, non-payment, or for any other reason with reasonable notice. Upon termination, your right to use our services ceases, but provisions that by their nature should survive termination (including payment obligations, limitation of liability, and dispute resolution) shall remain in effect.


19. Entire Agreement

These Terms, together with our Privacy Policy and any signed service agreements, constitute the entire agreement between you and Golden Concierge regarding your use of our website, app, and services. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
